EXPERT WITNESS LOSES MISCONDUCT CHALLENGE |

The forensic pathologist who carried out post-mortem tests on the two babies of Sally Clark has lost his High Court challenge against a decision that he was guilty of serious professional misconduct. The General Medical Council's Fitness to Practise Panel found Dr Alan Williams guilty of misconduct after hearing submissions that he did not disclose key test results on her children at her original trial. His lawyers argued at the High Court in London that Dr Williams had been "made a scapegoat" for the miscarriage of justice against Mrs Clark, and the disciplinary proceedings were unfair and "improperly prejudiced" him. But Mr Justice Davis ruled: "In my judgment this appeal fails on essentially every ground advanced. There was no procedural unfairness giving rise to injustice; nor were the findings and conclusions of the panel wrong." Lawyers for Dr Williams said they are now considering whether to appeal. Mrs Clark, a solicitor from Wilmslow, Cheshire, was wrongly convicted in 1999 of murdering her infant sons and freed on appeal in 2003. |
